关于律师刑事责任豁免权的思考

目前,世界上不少国家均不同程度地赋予了律师刑事辩护豁免权.是否应当赋予律师刑事辩护豁免权,针对我国律师刑事辩护前景堪忧的状况,我国律师界和法学理论界早已提出这一问题,且大多持肯定意见.赋予律师刑事辩护豁免权,其有明确的法理依据和现实依据,我国是否应当赋予律师刑事责任豁免权已经成为立法与司法亟待解决的问题.     

五四运动在宁波及其划时代的影响

五四运动如惊雷震撼九州，甬江沿岸掀起爱国怒潮。先进青年知识分子为先锋，通电声援，筹建爱国群体组织，游行示威，用各种形式上街宣传。同事，抵制日货，提倡购用国货。“六三”以后，宁波工人为主体的广大人民群众积极响应，运动的主力由学生转为工人，斗争形式由学生罢课发展为工人罢工、学生罢课和商人罢市的“三罢”斗争，工学商的联合行动把这场爱国斗争推向了高潮。五四运动对宁波发生影响，促进了宁波新文化运动发展和马克思主义普及，也为中共宁波地方党组织的创建在思想上、组织上奠定了基础。     

Challenges and Prospects for Economic Development in Africa

Africa's history of economic development and growth has been characterised by failed experiments, poor planning and impractical orthodoxies. This left the continent at the mercy of states and ruling elites who were unable to meet the challenges of both rising expectations from their citizens and the imperatives of sound policy design and implementation. Difficult existential conditions, including rising levels of poverty and bad governance, have been compounded by the vagaries of the international environment and Africa's peripheral position in its political economy and division of labour. Auspicious growth indicators over the last decade, fuelled mainly by global commodity demand and improved macro-economic management, have recently been undermined by the global financial crisis. The crisis has again exposed the continent to the spectre of depressed growth, with serious implications for state capacity and social welfare. This article examines the main ideological fault-lines, development challenges, and external factors that have characterised Africa's economic development and concludes that the future of the continent will remain one of this century's great challenges.     

中国共青团纪律建设的历史经验及对当代的启示——基于历届团章与团的组织建设文献的考察

共青团是党领导的具有鲜明政治属性的先进青年的群团组织,是党的助手和后备军。建团百年来,在党的领导下,中国共青团始终高度重视纪律建设。团的纪律建设,经历了新民主主义革命时期的初创和发展、社会主义革命和建设时期的完善和规范、改革开放和社会主义现代化建设时期的恢复和加强、中国特色社会主义新时代的改革和深化四个阶段。通过梳理团章、团的组织建设等文献中关于纪律建设的要求及其演进,可以归纳各个历史时期团的纪律建设的特点和做法,汲取从严治团的有益经验,为新时代加强团的纪律建设提供借鉴和参考。     

‘Social Investment’ or Back to ‘Familism’: The Impact of the Economic Crisis on Family and Care Policies in Italy and Spain

Family policies have traditionally been weak in Southern Europe. In the last two decades, however, and following a ‘catching up’ course, Spain has created new family programmes and expanded existing ones. Meanwhile, the picture for Italy during the years preceding the crisis is more of a ‘frozen landscape’. However, the diverging paths of the two countries in terms of policy reform in the years preceding the crisis do not place them in substantially different positions. The economic crisis and the austerity measures that followed have aggravated the weaknesses of family and care policies in both countries.     

宪政视野下的司法独立——基于中外宪法文本的比较研究

宪法是国家制度设计的蓝本,是宪政理念最直接的体现,是司法独立的一面镜子,更是实践司法独立思想的首要制度保障。司法独立思想来源于古希腊政治哲学家的宪政思想与分权制衡的理念,它具有三大特征:司法权独立,法院独立和法官独立。就司法权力的独立而言,主要西方国家有两大特征:一是设置了专门行使司法权力的机构;二是明确规定了司法权力的独立行使范围。1949年以前,我国宪法文本对于"司法制度"的设计与西方国家存在着很大的相似性,有几个宪法文本就是学习与借鉴英美国家来制定的。1949年建国以后,我国宪法文本中对于"司法制度"的设计也与之前的风格迥异。
